Introduction

Welcome to Taj Enclave, a premium housing society developed by Bajwa Construction (SMC-Pvt.) Ltd. These Terms and Conditions govern the purchase, booking, and ownership of residential and commercial plots within our PHATA approved gated community located on Kamra Road, Attock. By booking a plot or entering into any agreement with Taj Enclave, you acknowledge that you have read, understood, and agree to be bound by these terms.

Plot Booking & Payment Terms

Booking Process

  • All plot bookings require a signed booking agreement and initial down payment
  • Plot allocation is subject to availability and confirmation by Taj Enclave management
  • Booking forms must be completed with accurate information and supporting documentation
  • Plot selection is on a first-come, first-served basis for confirmed bookings

Payment Schedule

  • Payment plans are structured according to the agreed installment schedule
  • All payments must be made within the specified due dates to avoid penalties
  • Late payment charges of 1% per month will be applied on overdue installments
  • Payment methods include bank transfers, demand drafts, and online banking
  • All payments must be made in Pakistani Rupees (PKR)

Price Adjustments

  • Plot prices are subject to change based on market conditions and development phases
  • Confirmed bookings with signed agreements are protected from price increases
  • Additional charges may apply for premium location plots or corner plots

Development & Construction Guidelines

NOC Compliance

  • All construction must comply with PHATA approved building regulations
  • Building plans require prior approval from Taj Enclave management
  • Construction must adhere to community architectural guidelines and standards
  • Violation of building codes may result in construction stoppage and penalties

Construction Timeline

  • Plot development and infrastructure completion timelines are estimates
  • Delays due to weather, government regulations, or force majeure are not compensated
  • Regular updates on development progress will be communicated to plot owners

Quality Standards

  • Taj Enclave maintains high-quality infrastructure and amenity standards
  • Any defects in common areas will be addressed within reasonable timeframes
  • Individual plot construction quality is the responsibility of the plot owner

Rights & Responsibilities

Plot Owner Rights

  • Legal ownership transfer upon completion of full payment
  • Access to all community amenities and facilities
  • Participation in community decisions through resident associations
  • Right to sell, transfer, or lease the plot subject to community guidelines

Plot Owner Responsibilities

  • Timely payment of all dues and maintenance charges
  • Compliance with community rules and regulations
  • Proper maintenance of individual plots and properties
  • Respect for neighbor rights and community standards

Community Rules

  • Maintain cleanliness and environmental standards
  • Follow security protocols and visitor registration procedures
  • Comply with noise regulations and community guidelines
  • Participate in community welfare activities when required

Transfer & Resale Policies

Ownership Transfer

  • Plot transfers require written consent from Taj Enclave management
  • Transfer fees and documentation charges apply as per current rates
  • All outstanding dues must be cleared before transfer approval
  • New buyers must accept existing terms and conditions

Resale Conditions

  • Plot owners have the right to resell after completing 25% of total payment
  • Taj Enclave reserves the right of first refusal on all resale transactions
  • Resale documentation must be processed through official channels

Cancellation & Refund Policy

Cancellation Terms

  • Plot booking cancellation requests must be submitted in writing
  • Cancellation within 30 days: 90% refund of paid amount
  • Cancellation within 31-90 days: 80% refund of paid amount
  • Cancellation after 90 days: 70% refund of paid amount
  • Processing fees and administrative charges are non-refundable

Refund Process

  • Refunds will be processed within 60-90 working days of approval
  • Refund amounts are calculated after deducting applicable charges
  • No interest will be paid on refunded amounts

Force Majeure

Taj Enclave shall not be liable for delays or failures in performance due to circumstances beyond reasonable control, including but not limited to:

  • Natural disasters, earthquakes, floods, or severe weather conditions
  • Government actions, policy changes, or regulatory modifications
  • Labor strikes, material shortages, or supply chain disruptions
  • Pandemic situations or health emergencies affecting operations

Maintenance & Service Charges

Monthly Charges

  • Plot owners are responsible for monthly maintenance charges
  • Charges cover security, cleaning, utilities, and common area maintenance
  • Maintenance fees are subject to annual review and adjustment
  • Non-payment may result in service suspension and legal action

Utility Connections

  • Electricity, gas, and water connections are subject to utility company approvals
  • Connection charges and deposits are borne by individual plot owners
  • Taj Enclave facilitates utility connections but does not guarantee timelines

Legal Compliance & Dispute Resolution

Regulatory Compliance

  • All activities within Taj Enclave must comply with local and federal laws
  • Plot owners are responsible for obtaining necessary permits and approvals
  • Violation of laws may result in plot forfeiture without compensation

Dispute Resolution

  • All disputes will be resolved through arbitration in Attock jurisdiction
  • Pakistani law governs all agreements and transactions
  • Legal proceedings will be conducted in Urdu or English languages

Privacy & Data Protection

Information Security

  • Personal information provided during booking is kept confidential
  • Data is used solely for project communication and legal requirements
  • Information may be shared with authorized partners for service delivery

Communication Consent

  • Plot owners consent to receive project updates and promotional materials
  • Communication preferences can be updated through written requests

Amendments & Updates

Terms Modification

  • Taj Enclave reserves the right to modify these terms with proper notice
  • Significant changes will be communicated to all plot owners in advance
  • Continued plot ownership implies acceptance of updated terms

Notice Procedures

  • Official notices will be sent to registered addresses and contact information
  • Plot owners must update contact details for important communications
